GIFT CARDS – TERMS AND CONDITIONS OF USE

Issue
The Gift Card is issued by Tod’s S.p.A., a company duly incorporated in Italy with registered office in Via Filippo della Valle 1, Sant'Elpidio a Mare (FM), fiscal code / vat and registration number under the companies register of Fermo (Italy) 01113570442, share capital Euro 66.187.078,00 fully paid up, R.E.A.: no. 114030 Fermo (Italy) data processing n. FM 004894 (hereinafter referred to as the “Issuer”).
The Gift Card is issued and activated at a participating store managed by the Issuer, upon payment – in cash or via other payment methods accepted at the store – of a maximum amount of Eur 1,000.
No additional cost is required to activate and use it. Participating stores include those in Milan, Rome, Florence, Porto Cervo.
After activating the Gift Card at the cash register by paying the selected amount, the Customer will receive an issue receipt which indicates the amount that has been topped up. The amount placed on the Gift Card does not accrue interest.

Nature
The Gift Card is a voucher and, legally, is a “mere financial movement” in nature; VAT does not apply to the amount paid as the transaction takes the form of a money transfer.
The Gift Card is a bearer credit instrument and, as such, is a cash equivalent. For this reason, the Gift Card should be kept with extreme care as it can be used by any person in possession of it. Stores have no obligation to verify the identity of the person using the card. The Issuer or the participating stores expressly declines any liability concerning, by way of example and not limited to, the improper use, theft or loss of the card; these circumstances do not mean that the available credit will be replaced or refunded.

Use
The Gift Card is intended exclusively for one or more purchases of products from the participating stores managed by the Issuer, and at other Tod's Group boutiques in Europe. The updated list of boutiques is available at this link.
The Gift Card can be used for more than one purchase until the credit has been spent in its entirety, or as partial payment for a purchase. Any time the Gift Card is used, the credit is deducted by the corresponding amount and any remaining credit is still available for future purchases. If the credit available on the Gift Card is not enough to cover the purchase price, it can be used with other payment methods accepted by the store.
The balance will be printed on the receipt each time a purchase is made using the Gift Card.

Expiry
The Gift Card can be used for 12 months starting from when it is activated, the date of which is printed on the card’s issue receipt. After this expiry date, the Gift Card can no longer be used nor topped up, nor will the bearer be entitled to any form of reimbursement of the remaining credit.

Applicable Law
By purchasing and using the Gift Card, the acceptance of these terms and conditions of use is implicit. The Issuer reserves the right to modify and/or amend these terms and conditions at its own discretion, at any time.
Any disputes concerning the use of the Gift Card will be governed by the law Italian law.
